Nutzungs- und Publikationsrechte an Grabungsdokumentationen – eine Übersicht zu den Regelungen der Denkmalpflegeämter in Deutschland

Abstract

This article compiles the currently valid regulations of the stately agencies for archaeological preservation in Germany for the scientific exploitation and publication rights to archaeological materials and documentation resulting from excavations conducted by excavation companies and financed by the polluter pays principle. In many cases there are no publicly tangible rules, and in many cases it is claimed that the state owns exclusively the rights of use. From their point of view, publications may only be made in agreement with the respective state authority. Only the Brandenburg State Agency and, more recently, the heritage agency of Westphalia are taking a different approach.
